Terms of Service

By using HealKite you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the service. HealKite is operated by HealKite (TODO: registered legal entity).

HealKite is a technology platform that connects you with independent registered medical practitioners for online consultations, helps you obtain a valid e-prescription where the doctor considers it appropriate, and lets you order medicines. HealKite does not itself provide medical advice or practise medicine, and is not a party to the doctor-patient relationship.

The service is not for medical emergencies. If you or someone else may be in immediate danger, call your local emergency number or go to the nearest hospital right away. See the emergency guidance shown throughout the app.

You must be at least 18 years old and able to enter a legally binding agreement. A consultation for a minor or dependent must be requested and supervised by a parent or legal guardian. You are responsible for the accuracy of the information you provide and for keeping your account secure; you are responsible for activity under your account.

Consultations are provided by independent doctors who are solely responsible for the clinical advice they give, in line with the Telemedicine Practice Guidelines 2020. A doctor may decline to consult, or advise an in-person visit or tests, where an online consultation is not appropriate. You agree to provide honest, accurate information for your own safety.

A prescription is issued only when a doctor decides it is clinically appropriate, and never guaranteed. Certain medicines cannot be prescribed online. Where you order medicines, orders are fulfilled by a licensed pharmacy partner and are subject to a valid prescription where required by law.

Consultation fees are set by each doctor and shown before you confirm. Medicine prices and any delivery charges are shown before payment. Payments are processed by our payment partners. Cancellation and refund terms are described here: TODO (publish the refund/cancellation policy).

You agree not to misuse the service, including: impersonating another person, providing false information, attempting to obtain medicines or prescriptions improperly, disrupting the service, or infringing others' rights. We may suspend or terminate access for conduct that violates these Terms or puts users or doctors at risk.

The HealKite name, logo, software and content are owned by HealKite or its licensors and may not be used without permission. Content you provide during a consultation remains yours; you grant us the limited rights needed to operate the service and provide your care.

The platform is provided on an "as is" basis. HealKite does not provide medical advice and is not responsible for the clinical advice given by independent doctors. To the fullest extent permitted by law, HealKite is not liable for indirect or consequential loss, and our total liability for the platform is limited as permitted by applicable law. Nothing in these Terms limits liability that cannot be limited by law.

These Terms are governed by the laws of India. Subject to applicable law, the courts at TODO (city) will have jurisdiction. We encourage you to contact us first so we can try to resolve any concern.
